ORDER

The Criminal Original Petition is filed seeking a direction to the 1st respondent to execute the non-bailable warrant issued against the 2nd respondent on 26.02.2026 in C.C.No.107 of 2020 on the file of the learned IV Metropolitan Magistrate/Fast Track Court, George Town, Chennai.

2. The petitioner as complainant had filed a private complaint under Section 138 of the Negotiable Instruments Act against the second respondent in C.C.No.107 of 2020 before the Fast Tract Court No.IV, George Town, Chennai. The summons to the second respondent could not be served, hence NonBailable Warrant through the police was ordered and the Non-Bailable Warrant was submitted to the Inspector of Police, T6-Avadi Police Station, Avadi. Thereafter too, the Non-Bailable Warrant yet to be served.

3. The learned Government Advocate appearing for the first respondent produced a communication submitted before the Fast Tract Court No.IV, George Town, Chennai informing that the second respondent has left the address. He has also produced a certificate from the Village Administrative Officer, Avadi confirming the same. The same are extracted hereunder:

4. In view of the same, the petitioner is directed to provide the present address of the second respondent and take appropriate steps thereafter.
