A complaint given by one Sangeetha alleging that the petitioner has received money to arrange the job for the complainant's husband at 1/4

abroad, but had not made any arrangement. Therefore, the police has to recover the money from the petitioner herein. 2.

The police has registered the FIR based on the complaint and had issued summon to the petitioner herein to participate in the investigation. The petitioner states that it is purely a civil dispute, wherein he has made all arrangement for job to the complainant's husband, have collected service charge and he has gone abroad. The complainant has no locus to file a complaint against him, when the money was received from the husband of the complainant and service rendered.

This Court finds that it is purely a civil dispute and the petitioner herein has already participated in the enquiry on receipt of the summons issued under Section 161 Cr.P.C. Therefore, there is no necessity for the respondent police to frequently calling again and again. The respondent police shall complete the investigation without harassing the petitioner and if at all his presence is required and file final report if any cognizable offence is made out.

With the above observation, this Criminal Original Petition is disposed of.
