C.M.P.No.12516 of 2018 in S.A.No.2139 of 2004 N.SESHASAYEE,J., This Civil Miscellaneous Petition is filed to condone the delay of 2969 days in filing the petition to set aside the abatement caused due to the death of the Appellant namely Navanithakannan in the above second appeal.

2. Heard the learned counsel for the petitioner.

3. Having regard to the submissions made by the learned counsel for the petitioner and also having satisfied with the reasons stated in the affidavit filed in support of the petition, petition is allowed.
