JUDGEMENT The learned counsel for the appellant seeking permission of this Court to withdraw this second appeal however with liberty. He has made an endorsement to that effect.

2.In view of the above endorsement made by the learned counsel for the appellant this second appeal is dismissed however, it is made clear that dismissal of this second appeal will not be a bar for the appellant herein to file an appropriate suit for declaration of title based on documents, if he so advised. There shall be no order as to cost.
