ORDER

This transfer civil miscellaneous petition has been filed to withdraw the proceedings in H.M.O.P.No.932 of 2025 on the file of the Family Court, Puducherry to the Family Court, Chennai.

2.Heard learned counsel for the petitioner and perused the materials available on record.

3.Despite name printed in the cause list, there is no representation on the side of the respondent.

4.Learned counsel for the petitioner submits that the respondent is working as an Accounts Manager in a Private concern and filed a petition in H.M.O.P.No.932 of 2025 before the Family Court, Puducherry. The petitioner is residing with her parental home at Chennai along with her aged parents, who are aged about 65 and 55 years respectively. The petitioner's parents have incurred hand loans at the time of her marriage and are presently under financial strain. Due to the petitioner's health condition, she is unable to proceed long distance travel and she is financially incapable of bearing the recurring travel expenses to Puducherry and also it is very difficult for her to attend each and every hearing before the Family Court, Puducherry. Therefore, he prays to transfer the case to the VI Family Court, Chennai.

5.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel for the petitioner.

6.Considering the facts and circumstances of the case and the submissions made by the learned counsel for the petitioner, this Court is inclined to transfer the case on the file of the Family Court, Puducherry to the file of the VI Family Court, Chennai. Accordingly, the case in H.M.O.P.No.932 of 2025 is hereby withdrawn from the file of the Family Court, Puducherry and transferred to the file of the VI Family Court, Chennai. After receipt of the case papers from the Family Court, Puducherry, the VI Family Court, Chennai is directed to send a notice to both the parties within four weeks. After due service of notice, the VI Family Court, Chennai is directed to proceed with the matter in the manner known to law.

7.Considering the nature of avocation of the respondent, this Court is inclined to permit the respondent to appear through the Video Conferencing mode before the VI Family Court, Chennai. However, it is made clear that the respondent shall appear before the VI Family Court, Chennai as and when required.

8.With the above directions, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected civil miscellaneous petition is closed.
