This Writ Miscellaneous Petition has been filed for encashment of Fixed Deposit bearing Nos. 0485474 and 0485711 to the tune of Rs.14,70,254.00 so as to enable the petitioner to repay 18 staff loans of Indian Bank, Kodambakkam Branch and retain the remaining amount as Fixed Deposit in the name of the Registrar General, Madras High Court.

2. The learned counsel for the first respondent submitted that this Court, on 14.11.2019, while disposing of the main writ petition, has passed the following directions:

''a. that the aforesaid sums of Rs.56,627/- and Rs.24,90,409/- shall continue to remain in fixed deposit with the Madras High Court Branch of the first respondent till the 18 loan accounts granted to the staff of the petitioner and repayment of which has been quaranteed by the petitioner are fully discharged;

b. that after the aforesaid 19 loan accounts of the staff of the petitioner are closed, it would be open to the second respondent to approach this Court for encashing those fixed deposits for appropriating the proceeds towards the dues for the debt owed by the petitioner to the second respondent; and c. that if the debts owed by the petitioner to the first and second respondents are discharged in the meanwhile, it would be then open to the petitioner to make application to this Court for payment from those fixed deposits.''

In the aforesaid circumstances, total outstanding of the 18 loan accounts with Indian Bank Kodambakkam Branch is Rs.14,70,254.00 as on 30.06.2020. The total amount available in the name of the Registrar (General) is Rs.25,47,036/-. From this total amount Rs.25,47,036/- the total outstanding amount of Rs.14,70,254/- in respect of the 18 staff loans may be adjusted and their loan accounts with the first respondent may be closed.

3. The learned counsel appearing for the petitioner as well as the second respondent have not raised any objection in this regard.

4. In view of the above, the Registrar General, High Court of Madras, shall disburse the balance amount to the second respondent as expeditiously as possible and accordingly, this Writ Miscellaneous Petition is closed.
