to quash the same in so far as the payment of interest and penal interest to the tune of Rs.3,57,222/- is concerned and consequently to settle the retirement benefits payable to the petitioner by deducting the unpaid instalment amount of Rs.2,79,500/-.

ORDER

The learned counsel appearing for the petitioner seeks permission of this Court to withdraw the writ petition and he has also made an endorsement to that effect.

2. In view of the submission and endorsement made by the learned counsel for the petitioner, the writ petition is dismissed as withdrawn, granting liberty to the petitioner to file a fresh Writ Petition for the same cause of action. No costs. Consequently, the connected miscellaneous petitions are closed.
