Respondents/Defendants/ Respondents Prayer:- This Memorandum of Second Appeal is filed under Section 100 of Civil Procedure Code against the Judgment and decree dated 20.12.2013 and made in the appeal in A.S.No.102 of 2007 on the file of the V Additional District and Sessions Court, Coimbatore, reversing the judgment and decree dated 05.11.2003 and made in the suit in O.S.No.741 of 2000 on the file of the III Additional Subordinate Court, Coimbatore. J U D G M E N T

It is brought to the notice of this court by Mr.C.R.Prasanan, learned counsel appearing for the appellant, that the dispute between the parties to the appeal has been settled out of Court. He has also filed the affidavit of the appellant dated 12.04.2016 to that effect saying that pursuant to outside court settlement between the appellant on one hand and the respondents 1 & 2 on the other hand, it is decided to withdraw the above Second Appeal. Accordingly, the learned counsel seeks permission of this Court to withdraw the Second Appeal. The said affidavit is taken on record and the appellant is permitted to withdraw her appeal.

2. In view of the contents of the affidavit filed by the appellant, this second appeal is dismissed as withdrawn. Registry is directed to refund half of the court fee paid on the memorandum of the Second Appeal.
