This petition has been filed to enlarge the petitioner on bail in crime No. 845 of 2023 on the file of the respondent police. 2.The case of the prosecution is that the respondent police seized 49 kgs of Ganja from the accused persons. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and ready to abide any conditions. He prays to allow this petition.

4. The learned Government Advocate (Crl. side) submits that 49 kgs of Ganja has been seized from the petitioner.

5. Considering the fact that more than 49 kgs of Ganja has been seized from the petitioner which is commercial quantity. On seeing the gravity of the offence, this court is not inclined to allow this petition. However, the learned counsel for the petitioner submits that the investigating officer has no right to conduct search. This Court is of the view that the petitioner can take such defence before the Trial court. Accordingly, the petition is dismissed.
