ORDER
This Writ Petition has been filed seeking to direct the 2nd respondent to survey and demarcate the property, which according to the petitioner is owned by him, based on his online application, dated 08.10.2024, with the assistance of the 3rd respondent, within a time frame to be fixed by this Court.
2. The petitioner had submitted an application through on-line on 08.10.2024 for the aforesaid purpose. Since the same was not considered by the official respondents till date, the petitioner has filed this writ petition.
3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 & 2 and Mr.V.Meganathan, learned Government Advocate (Crl.Side), accepts notice on behalf of the 3rd respondent. Since no
adverse orders are passed against the 4th respondent in this writ petition, notice to the 4th respondent is dispensed with.
4. No prejudice would be caused to the respondents, if the 2nd respondent is directed to survey and demarcate the boundaries of the petitioner's property morefully disclosed in the prayer to this writ petition, after hearing the objections, if any, from the 4th respondent, the neighbouring land owners as well as any other party whom they deem fit to put on notice, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the 2nd respondent is directed to issue notice to the 4th respondent, the neighbouring land owners, and also to any other party, if they deem fit to put on notice.
(b) After receiving objections if any and after considering the same, the 2nd respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
(c) If the need arises for police assistance and on a request made by the respondents 1 and 2, the 3rd respondent shall
render police assistance for the effective implementation of this order.
(d) There shall be no order as to costs.
