Visalakshi Suresh And 5 Others v. M/S Green Avenue Homes (P) Ltd.,And 2 Others

A.No.2557 of 2024 in C.S.No.27 of 2022 RMT.TEEKAA RAMAN,J.

This Civil Suit has been filed before this Court for Specific Performance of the suit sale agreement. The original land owner has also filed a suit in O.S.No.404 of 2017, which was transferred to City Civil Court, Chennai, and re-transferred to this Court, and re-numbered as C.S.No.22 of 2022 for cancellation of the suit sale agreement. A joint trial was ordered.

2. The defendant in C.S.No.87 of 2019 has now filed an Encumbrance Certificate.

3. On the last occasion, this Court directed the learned counsel to get instructions on whether the encumbrance certificate sought to be produced as further documents by the plaintiff is a certified copy or xerox copy, a print - out from the internet.

4. Today, the learned counsel has submitted that it is a print out from the internet from the Tamil Nadu Registration Website and has undertakes to file necessary application is required under Section 65 of the Indian Evidence Act.

5. Hence subject to proof of relevancy, this application is ordered.

6. Post the matter before the learned Master on 19.09.2024 for appearance of the defendant side evidence.
