A.No.3354 of 2019 in CS.SR.No.55667 of 2019 A.No.3354 of 2019 in CS.SR.No.55667 of 2019 K.KALYANASUNDARAM, J This application has been filed to grant leave to the applicants/plaintiff to file suit against the first respondent/first defendant-Trust and its Trustees viz., respondents/defendants 2 to 7.

2. Mr.G.RM.Palaniappan, the learned counsel appearing for the applicants would submit that the applicant is one of the Trustees of the first respondent-Trust and the Trust fund is being siphoned of by the respondents 2 to 7. Though money has been withdrawn from the Bank account, but no proper voucher has been filed. It is further submitted that though the respondents have filed counter affidavit and produced vouchers as per the order of this Court dated 15.07.2019 and 22.07.2019, they are not tallying with the statement given by the applicants.

3. Considering the submissions made by the learned counsel for the applicant and also considering the averments made in the affidavit filed in support of the application, leave is granted. 31.10.2019 KMI Note: Registry is directed to number the suit, if it is otherwise in order.
