Condition imposed by this Court vide order dated 27.08.2021 in A.No.2887 of 2021 is complied with. Affidavit of service dated 13.09.2021 has been filed to that effect. The reply statement to the written statement cum counter claim filed by the 1st respondent / 1st defendant is taken on file.

2.Learned counsel for the 2nd defendant submits that he has filed the written statement along with the condone delay application only on 15.09.2021. He added that the suit summons was not served on him and hence he was not certain about calculation of the delay.
