PRAYER Civil Revision Petition filed under Article 227 of the Constitution of India, praying to SET ASIDE the Judgement and Decree dated 23.03.2026 passed in R.L.T.A.No.10 of 2026 by the XVII Additional City Civil Court, Chennai, confirming Judgement and Decree dated 13.08.2025 passed in R.L.T.O.P.No.97 of 2024 by the XV Small Causes Court, Chennai. Heard both sides.
2. When the matter was taken up, learned counsel for the revision petitioners submits that 3rd petitioner Vijayakumar died and he was one of the partners of the first petitioner firm. Therefore, the counsel for the petitioners wants to bring the Legal Heirs of 3rd petitioner on record and he is awaiting for Legal Heir certificate.
3. It is further submitted that the RLTA court by judgment dated 23.03.2026 confirmed the findings of the RLTOP Court order dated 13.08.2025. Challenging the eviction order passed by the courts below, this Civil Revision Petition is filed before this court on 27.03.2026. Pending Revision, 3rd petitioner died on 21.05.2026. The learned counsel for the petitioners submits that they want to get the legal heirs impleaded , but till date, they are not able to get legal
heir certificate. But before the death of 3rd petitioner, the 1st appellate court has confirmed the findings of the RLTOP court in RLTA.No.10 of 2026, wherein, eviction order was confirmed. This court is not inclined to accept the contentions of the learned counsel for the revision petitioners. The courts below elaborately analysed the entire evidence and documents and passed the order of the eviction. This revision has no merits. If at all the legal heirs are in possession, as they bound by decree, so they have to vacate the premises and handover the same to respondents/Landlords.
4. The learned counsel for the respondents/landlords submits that as on date E.P., is pending. Therefore, liberty is granted to the revision petitioners to implead the Legal Heirs of the 3rd petitioner in the Execution Proceedings and proceed and the Executing Court shall dispose of the E.P., within 3 months.
5. This Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
