(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 07.08.2020 for the offences punishable under Section 4(1) (aaa), 4(1)(i) & 4(1-A) of Tamilnadu Prohibition Act and Section 328 IPC r/w Sections 6 and 7 of the Tamilnadu Prohibition of Smoking and Spitting Act 2002 and Section 188 and 269 IPC, in Crime No.697 of 2020, seeks bail.

2.The case of the prosecution is that the petitioner was illegally found in possession of 60 beer bottles, 395 brandy bottles and 5 Kg of Mava.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl. Side) would submit that the petitioner was illegally found in possession of 60 beer bottles, 395 brandy bottles and 5 Kg of Mava. He would further submit that the petitioner has six previous cases out of which five cases are of similar nature. He would further submit that the petitioner was arrested very recently on 07.08.2020 and the investigation is in initial stage. Hence, he vehemently opposes for the grant of bail to the petitioner.

5.Taking into consideration of the antecedents of the petitioner and also considering the fact that the petitioner was arrested very recently on 07.08.2020, this Court is not inclined to grant bail to the petitioner for the present.
