family to worship and to participate in the Mariyamman temple festival which was going to celebrate on 02.04.2026 and to pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The present writ petition has been filed by the petitioner seeking a direction to the second respondent to provide necessary police protection to the safety and security of the petitioner and his family and also for worship during Mariyamman temple festival.

2.It is the contention of the learned counsel appearing for the writ petitioner that the petitioner had given a complaint to the second respondent police on 17.02.2026, based on which a CSR No.18/2026 was registered on 22.02.2026. It is stated in the complaint that the petitioner is a resident of Iraiyamangalam village, Tiruchengode Taluk. The villagers in the said village are conducting temple festival and that the villagers are refusing to receive the contribution of the petitioner and thereby denying the petitioner's participation in the temple festival and the petitioner and his family were also threatened by the villagers and therefore, seeking to take appropriate action, the complaint has 2/6

been preferred before the second respondent police. It is contended that earlier a writ petition being W.P.No.33222 of 2025 has been preferred and this court vide order dated 02.09.2025, had directed the revenue authorities to conduct peace committee meeting and to resolve the issue. Based on the said order, the Revenue Divisional Officer, Tiruchengode has conducted enquiry on 23.12.2025 and both parties have agreed that there will not be any discrimination and with the participation of the petitioner and his family, the temple festival would be held. But, on the contrary, during Sivarathiri festival, on 15.02.2026, the petitioner was denied participation in the festival and again, he was boycotted and therefore, he has filed a complaint before the second respondent and no action has been initiated which prompted the petitioner to file the present writ petition.

3.Learned Additional Public Prosecutor who took notice for respondents 1 and 2, has submitted that earlier there was a peace committee meeting and the issue got resolved and now, the petitioner is making specific allegation in the complaint against respondents 3 to 6 for not allowing the petitioner in the temple festival. The learned Additional Public Prosecutor submitted that the respondents police will make due enquiry based on the complaint of the petitioner within a reasonable period.

4.Heard the learned counsel for both sides. It is the specific allegation of the petitioner that the petitioner and his family have been denied participation in 3/6

the temple festival. The court is of the view that there shall not be any discrimination to any one in the temple festival. The temple festival is a public event and therefore, denying participation during temple festival for some one would not be proper and that action shall be initiated against those who are preventing the participation in the temple festival. In this view of the matter, the second respondent police is directed to conduct enquiry based on the complaint of the petitioner which was assigned CSR No.18 of 2026 and take appropriate action in the manner known to law, after giving notice to private respondents 3 to 6. The said exercise shall be completed within a period of three weeks after the general election is completed. The second respondent shall ensure that nobody is discriminated more particularly the petitioner and his family members and the petitioner and his family members shall be permitted to participate in the temple festival which is a public event.
