The learned counsel for the applicant would submit that pursuant to the order passed by this Court dated 13.02.2024, 75% of the award amount was deposited by way of 6 instalments and hence, he requests this Court to number the above petition.

2. Recording the above submission, the Registry is directed to number the above Arbitration Original Petition and list the same under the caption for Admission.

3. Since the issue involved in the present application is with regard to the limitation, which is a preliminary issue, this Court is of the view that the same shall be raised in the above Original Petition, once if it is numbered and listed before this Court. Hence, this Court is inclined to close this application.

4. Accordingly, this application is closed with liberty to raise the said issue of limitation in the above original petition, once it is numbered and listed before this Court.
