O R D E R

This criminal original petition has been filed to direct the respondent police to register a case on the basis of the petitioner's complaint dated 06.07.2015 and/or to proceed to investigate the same under the Tamil Nadu Protection of Interests of Depositors (in Financial Establishment) Act 1997, as amended upto date, in accordance with law.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is seen that already the respondent police have registered a case in Crime No.5 of 2015 against the same accused and any further complaint given by investor can only be treated as a statement 161 Cr.P.C.

4. Under such circumstances, the petitioner's complaint may be enquired into and the same may be treated as a statement 161 Cr.P.C and he be enlisted as a prosecution witness. In view of the above, the criminal original petition is closed.
