Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus to call for the entire records relating to the detention of petitioner's son namely Vivek S/o. Selvaraj, aged about 31 years u/s. 3(1) r/w 3(2)(a) of the Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act 1980 (Central Act of 1980) in Cr.MP.No. 14/BM/2022/E1 passed by the file of the 3rd respondent herein and quash the same as illegal and consequently direct the respondents herein to produce the person or body of the detenue Vivek, S/o.of Selvaraj, now confined at Central Prison, Coimbatore. ORDER
(Made by RMT.TEEKAA RAMAN, J.) The petitioner challenges the impugned order of detention in Cr.MP.No. 14/BM/2022/E1 dated 28.04.2022 detaining his son as "Black Marketeer", as contemplated under Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act, 1980 (Central Act 7 of 1980).
The learned Additional Public Prosecutor reports that the order of detention passed against the detenu has been revoked by the
Government by its order in G.O.Rt.No.195, Home, Prohibition and Excise (XI) Department, dated 24.05.2022 and he has also produced a copy of the Government Order. Recording the same, this Habeas Corpus Petition stands closed.
