ORDER

This petition has been filed seeking a direction to the first respondent to change the investigation pending on the file of the second respondent to the other Investigation Officer. On the complaint lodged by the petitioner, the second respondent registered a case in Crime No.207 of 2020 for the offence under Sections 454 and 380 of IPC.

2. The case of the petitioner is that on 23.03.2020, when the petitioner returned to his home after work, he noted that the bureau was broken and 15 Sovereigns of gold and silver ornaments were stolen by the unknown persons.

3. It is also seen that after registering the FIR, the second respondent did not even verify any CCTV Footage available in the street.

4. The learned Additional Public Prosecutor submitted that a case was registered for the offence under Sections 454 and 380 of IPC and they are yet to find the accused, who have committed https://hcservices.ecourts.gov.in/hcservices/

the offence. They are also searching the accused after verification of CCTV Footage and no clue is available to trace out the accused.

Considering the above nature of crime, change of investigation from the file of the second respondent would not serve any purpose and it would also affect the investigation done by the second respondent herein. However, the second respondent is directed to complete the investigation within a period of sixteen weeks from the date of receipt of a copy of this order. The first respondent is directed to monitor the investigation done by the second respondent.

This Criminal Original Petition is disposed of accordingly.
