Respondents PRAYER: Writ Petition has been filed under Article 226 of Constitution of India to issue a writ of Mandamus, directing the Respondents 1 to 3 herein to enquire the Petitioner's complaint dated 25.04.2016 and take necessary steps to recover his advance money of Rs.1,01,00,000/- from the Respondents 4 & 5 for the ill-intention (mens rea) to cheat Petitioner's advance money paid for purchasing landed properties in Chengappalli Village and punish the accused under section 420 of I.P.C. r/w. Section 34 of I.P.C.

O R D E R

This writ petition has been filed seeking for a direction to the respondents 1 to 3 to enquire into the

petitioner's complaint dated 25.04.2016 and take action in accordance with law.

2.It is seen from the records that the petitioner had already approached this Court with a similar prayer and this Court by an order dated 17.09.2018 made in Crl.O.P.No.15368 of 2016 has disposed the petition on the ground that both the complaint as well as the F.I.R. have been closed. In view of this order, the present writ petition cannot be entertained. 3.It is left open to the petitioner to work out his remedy in accordance with law by filing a private complaint since already his compliant in CSR.No.120 of 2014 and F.I.R. in Crime No.998 of 2011 has already been closed.
