PRAYER: This criminal original petition has been filed under Section 528 of BNSS, to permit the petitioner to withdraw the sum of Rs.2,00,000/- (Rupees two lakh only) deposited by the petitioner before the XIV Metropolitan Magistrate Court, Egmore, Chennai District in F.I.R. Crime No.498 of 2022 in view of the order passed in Crl.O.P.No.31738 of 2022 dated 04.01.2023.

ORDER

The petitioner who apprehends arrest for the offence under Section 406 and 420 of I.P.C. filed anticipatory bail before this Court in Crl.O.P.No.31738 of 2022 had granted anticipatory bail, interalia, on the condition that the petitioner should deposit a sum of Rs.2,00,000/- to the credit of Cr.No.498 of 2022.

2.The instant petition has been filed seeking permission to withdraw the said sum deposited by the petitioner on the ground that the First Information Report against the petitioner was quashed by this Court in Crl.O.P.No.2483 of 2023 by the order dated 05.02.2025. 3.The learned Government Advocate (Criminal side) confirms the fact that the First Information Report in Cr.No.498 of 2022 has been quashed.

4. In view of the aforesaid facts and submissions the petitioner is permitted to withdraw the sum of Rs.2,00,000/- deposited to the credit of Page No.2 of 5

Cr.No.498 of 2022 by filing a suitable application. On receipt of the application, the learned Magistrate may return the amount as expeditiously as possible.
