O R D E R

This petition has been filed to direct the learned Judicial Magistrate No.I, Thiruvanamalai, Thiruvanamalai District to consider the surrender petition of the petitioner on the same day and enlarge him on bail in C.C.No.225 of 2008.

2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor for the respondent and perused the materials placed on record.

3. It is seen that this petitioner is facing trial for offences under Section 138 of Negotiable Instruments Act, which is bailable. On 14.04.2015, the petitioner has not appeared before the Trial Court and hence, non-bailable warrant has been issued.

4. Since the petitioner has been charged under Section 138 of Negotiable Instruments Act, no anticipatory bail can be granted. However, the petitioner is directed to surrender before the Trial Court and pray for recall of warrant and also furnish a bond under Section 88 Cr.P.C for Rs.10,000/- with two sureties and on such bond https://hcservices.ecourts.gov.in/hcservices/

being furnished, the warrant may be recalled. For the subsequent hearings, the petitioner shall co-operate with the Trial Court, since this case is of the year 2008.
