JUDGMENT

This appeal has been filed to set aside the judgment dated 03.04.2007 in C.C.No.431 of 2004 passed by the Judicial Magistrate No.II, Coimbatore.

2. There is no representation on either side. Notes paper also reveals that the appellant reported dead. Notice sent to the counsel for the appellants was also returned as unserved. Appeal itself is filed as against the dismissal of the complaint filed for the offence under Section 499 IPC for alleged defamatory statements said to have been made by the respondents. As the appellant died nothing survives in this appeal.

4. Accordingly, the Criminal Appeal is dismissed as infructuous.
