ORDER
This Civil Revision Petition has been filed seeking to set aside the Order passed in OS.SR.No.1105 of 2026 on the file of the Additional District Munsif Court, Thiruvallur dated 25.03.2026 and to direct the Learned Addtitional District Munsif, Thiruvallur to take the returned plaint in OS.SR.No.1105 of 2026 and to number the same.
2. The learned counsel for the petitioner submits that Bar Council of Tamil Nadu & Pondichery addressed letter dated 04.12.2025 & 05.02.2026 instructed not to conduct the election until further orders. However, on 18.02.2026, the respondents clandestinely selected the office bearers without adhering to the instruction given by the Bar Council of Tamil Nadu &
Pondicherry. Further, the respondents attempting to collect subscriptions from the members and also trying to withdraw money from the Association. Hence, the petitioner filed the suit before the Trial Court for the relief of permanent injunction. However, the Trial Court returned the plaint stating that as it is not maintainable.
3. Records perused. The reason submitted by the learned counsel for the petitioner is reasonable. The Additional District Munsif Court, Thiruvallur, is directed to number the plaint and take the case on file within a period of two weeks from the date of receipt of a copy of this order. Further, the Registry is directed to return the original plaint to the petitioner within a week.
4. In the result, this Civil Revision Petition is allowed. No Costs. Pending petition, if any, is closed.
