ORDER
The writ petition has been filed seeking a direction to the respondent to refund the petitioner's deposited amount along with interest, based on the representation dated 30.12.2025.

The case of the petitioner is that he and his wife had deposited a sum of Rs.15,00,000/- during the years 1998-99 with Abilash Auto Finance and Suba Swathi Auto Finance, Coimbatore, on the promise of interest at 24% per annum. However, the said financial establishments failed to repay the deposits, resulting in registration of a criminal case in Crime No.1 of 2000 by the Deputy Superintendent of Police, EOW-II, Coimbatore, which culminated in filing of a charge sheet in C.C. No.8 of 2008 before the Special Court under the TNPID Act.
3. It is further stated that though properties were attached and an enquiry was conducted pursuant to earlier orders of this Court, the petitioner has not received any amount till date. The petitioner had earlier approached this Court in W.P. No.894 of 2025, which was disposed of with a direction to consider his representation. Pursuant thereto, the petitioner made a representation dated 30.12.2025, which has not been considered, till date. Hence this writ petition.
4. Learned counsel for the petitioner submitted that despite the lapse of several years and despite attachment of properties under the TNPID Act, the petitioner has not been repaid his deposit. He further submitted that pursuant to earlier directions of this Court, the petitioner made a representation and even participated in the enquiry, wherein his claim was found to be genuine. However, no steps have been taken to refund the amount. He further contend 2/5
that the petitioner is entitled to refund along with interest, in the light of the orders passed by the Hon'ble Supreme Court in Crl. Appeal Nos.931-932 of 2023.

Per contra, the learned counsel appearing for the respondents submitted that the matter relates to proceedings under the TNPID Act and disbursement of amounts to depositors is subject to the process of identification and verification. He further submitted that necessary steps are being taken in accordance with law and that the petitioner's claim will be considered along with other similarly placed depositors.
6. This Court has considered the submissions made by the learned counsel on either side and perused the materials available on record.

On perusal of records, this Court is of the view that the claim of the petitioner requires consideration by the competent authority, in accordance with the procedure contemplated under the TNPID Act and the orders passed by the Hon'ble Supreme Court, particularly with regard to distribution of amounts on a proportionate basis among eligible depositors.
8. Considering the same, without expressing any opinion on the merits, the respondent is directed to consider the petitioner's representation dated 30.12.2025, and upon satisfaction, shall refund the eligible amount on 3/5
proportionate basis, in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
