By this miscellaneous petition, a request was made to modify the order dated 05.04.2024 in WP.No.9227 of 2024. The request for modification was made in view of the appropriation of a sum of Rs.14,12,300/- from the petitioner's bank account on 12.01.2024. Learned counsel for the petitioner submits that 10% of the disputed tax amount would be about Rs.17.3 lakhs and that the amount appropriated may be adjusted. He further submits that the petitioner would make good the short fall.

2. Since the order dated 05.04.2024 was issued without taking into consideration the appropriation of a sum of Rs.14,12,300/-, it is just and necessary to modify the order. Accordingly, the order is modified by directing the respondent to adjust the remittance made by the petitioner earlier against the 10% remittance. The petitioner is directed to make good the short fall within two weeks from the date of receipt of a copy of this order.
