This petition has been filed to direct the first respondent to transfer the investigation in Crime No. 471 of 2016 to some other agency and to file the final report as early as possible.
2. The grievance of the petitioner is that the complaint clearly discloses the offence under section 304 (B) IPC, whereas the respondent police have registered a case under section 306 IPC.
3. In my view, implicating the accused for offence is within domain of the respondent police and this need not be circumvented by interfering with the investigation.
4. Nevertheless, the learned counsel for the petitioner submits that though the complaint was filed on 16.11.2016, there was no effective progress in the investigation. In view of the same, it would be appropriate to direct the first respondent herein to complete the investigation and to file a final report/ charge sheet.
4. Hence there shall be direction to the second respondent herein to complete the investigation within six seeks and to file final report/ charge sheet. Such an exercise shall be monitored by the first respondent police.
