Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the first respondent to dispose of the arbitral application dated 4.12.2006 and additional claim petition dt.11.1.2025 filed by the petitioner along with his brothers and sisters under section 3(G)(5)of National Highways Act, 1956 for enhancement of compensation for the acquired lands admeasuring 1650 sq.m comprised in Sy.No.118/2B 1400 sq. M comprised in Sy.No.120 and 116 sq.m comprised in Sy.No.122/1B situated at Athipattu village, Ambattur Taluk, presently Chennai District, Kancheepuram District (previously).

This writ petition has been filed for issue of a writ of mandamus directing the first respondent to dispose of the arbitration application filed under Section 3G(5) of the National Highways Act, 1956, on 04.02.2006 and pass orders within a time frame fixed by this Court.

2. Heard the learned counsel for the petitioner, the learned Additional Government Pleader for R1 and R2 and the learned Standing Counsel for R3.
3. The property belonging to the petitioner was acquired and compensation was fixed by the award passed by the competent authority on 10.11.2006. Not being satisfied with the quantum of compensation, the petitioner filed an appeal before the first respondent under Section 3G(5) of the National Highways Act, 1956. Since the same was not considered for a long period of time, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, the petitioner is directed to submit a fresh representation before the first respondent along with all relevant documents and also a copy of this order. On receipt of the same, the first respondent is directed to pass final orders in the appeal filed by the petitioner, after affording an opportunity to the third respondent, within a period of eight weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of in the above terms. There shall be no order as to costs.
