Decree : This Civil Miscellaneous Appeal coming on for hearing as to admission on this day, upon perusing the grounds of Appeal, the award of the Tribunal below and the material papers in this case and upon hearing the arguments of Mr.A.N.Viswanatha Rao, Advocate for the Appellant and Mr.J.Chandran for the Second Respondent, wherein 1st Respondent having set exparte in Lower Court itself and till this day, this Court doth order and decree as follows:

1) that the compensation award and decree dated 19.01.2012 made in MACT O.P.No.1865/2008 on the file of Motor Accidents Claims Tribunal at Chennai, V Judge, Small Causes Court, Chennai, be and hereby is confirmed and this Civil Miscellaneous Appeal is dismissed.

2) the Second Respondent herein/National Insurance Co Ltd., do deposit the award amount along with interst and costs less the amoutn already deposited, if any, within a period of eight weeks from the date of receipt of a copy of this judgment to the credit of MACT O.P.No.1865/2008. https://hcservices.ecourts.gov.in/hcservices/

3) that on such deposit being made, the tribunal shall transfer the award amount directly to the Bank account of the Appellant/claimant through RTGS within a period of 2 weeks.

4) that there be no costs in this Civil Miscellaneous Appeal.
