ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 454 & 380 of I.P.C., in Crime No.800 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner colluded with other accused and broke open the defacto complainant's house and stolen the cash of Rs.4,50,00,000/- and 30 sovereign of gold jewels. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the stolen property has been recovered from other accused and hence he prays to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor would submit that the petitioner is a key man in this crime and a portion of the property is still under the custody of the petitioner. The petitioner are still absconding and he moved this anticipatory bail petition and hence he vehemently opposed to grant anticipatory bail to the petitioners.

5.Considering the facts and circumstances of the case, this Court feels that the custodial interrogation of this petitioner is very much required in this case and hence this Court is not inclined to grant anticipatory bail to the petitioner. When this Court about to dismiss the petition, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw the petition and also he made an endorsement to that effect. 6.In view of the submission and endorsement made by the learned counsel for the petitioner, this petition is dismissed as withdrawn. -sd/- 06/06/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
