Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, to direct the respondents to pass orders on the representation made by the petitioner dated 22.09.2014 in the light of the proposal sent by the 2nd respondent dated 04.05.2015 with all consequential service and monetary benefits.

By consent, the writ petition is taken up for final disposal. 2.The petitioner would state that he was enlisted as constable on 15.04.1997 and got promoted as Havildar on 18.03.2004 and subsequently, got promotion as the Sub-Inspector of Police on temporary basis on 03.07.2008 and his service was regularised in the said post on 18.09.2010. The petitioner would claim that he has all along rendered meritorious service.

3.The petitioner while serving as the Sub-Inspector of Police in the Tamilnadu Special Police in TSP XV Battalion, Avadi, made representation dated 15.04.2014 to the 3rd respondent herein stating that he want to forego the post of the Sub-Inspector of Police due to family circumstances and willing to join as Head Constable by way of demotion in Vellore District. The 3rd respondent, based on the request made by the petitioner, vide Memorandum dated https://hcservices.ecourts.gov.in/hcservices/

29.04.2014, sought certain clarifications and it was responded to by the petitioner vide his reply dated 17.05.2014. 4.The grievance expressed by the petitioner is that though he is willing to forego the said post and prepared to work as Head Constable due to compelling family circumstances, no orders have been passed in spite of the fact that the Additional Director General of Police [Armed Police], Chennai, has also requested the 1st respondent, viz., the Director General of Police, to pass orders at an early date.

5.Heard the submissions of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents.

6.This Court, taking into consideration the limited scope of prayer sought for by the petitioner and in the light of the letter dated 04.05.2015 written by the 2nd respondent to the 1st respondent, directs the 1st respondent to consider the request of the petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner herein.
