JUDGMENT
This criminal appeal has been directed against the order of acquittal passed in C.C.No.293 of 2000 by the Additioanl District Munsif-cum-Judicial Magistrate, Ambur, Vellore. 2.
The appellant herein as complainant has filed the complaint in question under Section 138 of the Negotiable Instruments Act on the file of the Trial Court and the same has been takenon file in C.C.No.290 of 2000 wherein the present respondent has been shown sole accused. 3.
The Trial Court after considering the available evidence on record has dismissed the complaint and consequently acquitted the accused. Against the order acquittal, the present criminal appeal has been filed at the instance of the complainant, as appellant.

After admission, notice has been sent to the respondent-accused and the same has been returned stating that the respondent-accused has passed away and to that effect the concerned Village Administrative Officer has given a certificate.

Considering the aforesaid factual circumstances, this appeal has become infructuous.
