Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, to direct the respondents to pass orders granting promotion to the petitioners in Ministerial services in School Education Department based on their eligibility and seniority in the 2% vacancies earmarked for Ministerial services for School Education Department for promotion to the post of P.G.Assistant in the relevant subject from the panel year 2014 onwards, following the year wise panel, with all consequential and other attendant benefits, by considering the representation submitted by the petitioner dated 26.03.2021.

ORDER

This writ petition has been filed seeking a writ of mandamus to direct the Page No. 4 of 8

respondents to pass orders granting promotion to the petitioners in Ministerial services in School Education Department based on their eligibility and seniority against the 2% vacancies earmarked for Ministerial services for School Education Department to the post of P.G.Assistant in the relevant subject from the panel year 2014 onwards, by following the year wise panel, with all consequential and other attendant benefits.

When the matter is taken up for consideration, it is brought to the notice of this Court, by way of counter affidavit, that 2% vacancies earmarked for Ministerial staff working in the School Education Department in the cadre of P.G.Assistant for the panel years 2014-2015 to 2020-2021 worked out to 164 posts and out of which, 125 vacancies have been filled up and balance 39 vacancies are reserved for other categories. It is further stated that the respondents would prepare the panel as per the provisions of Tamil Nadu Higher Education Subordinate Rules from the year 2021 onwards.

3. In the light of the above, the issue raised in the writ petition does not survive. The paragraph No.15 of the counter affidavit filed by the respondents Page No. 5 of 8

which reads as under:- "15.It is further submitted that only after the while following the order of priority the 125 vacancies out of 164 vacancies has been filled on 06.02.2021 by the persons in the cadre of Superintendent, Assistants, and Junior/Typist. The balance 39 vacancies are reserved for appeal and other criteria. The petitioners in the present writ petitions are only working as Junior Assistant and Typists names are included as on 01.01.2021 Panel. Henceforth the panel would prepared as per the provisions of Tamilnadu Higher Secondary Service Special Rules."

In the light of the above statement made in the counter affidavit, there is no need to examine the matter on merits and accordingly, this writ petition is disposed of directing the respondents to take all necessary steps for filling up of 2% posts in the cadre of P.G. Assistant earmarked to be filled in by way of appointment by transfer from among the Ministerial staff working in School Education Department, as expeditiously as possible at any rate within a period of two months from the date of receipt of a copy of this order. No costs. Consequently, connected writ miscellaneous petition is closed. 23.07.2024 Page No. 6 of 8
