The petitioner, who was arrested and remanded to judicial custody on 10.03.2024 for the alleged offences punishable under Sections 294(b), 307, 323, 341, 392, 506 (ii) of IPC and 3(1) of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, in Crime No.71 of 2024 on the file of the respondent Police, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner (A1), aged about 26 years is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the alleged offence and he is in custody from 10.03.2024. He also submitted that the similarly placed co-accused has been granted bail by this Court and further, the petitioner is also ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection stating that the petitioner along with other accused, who are the friends of the de facto complainant's brother, in an inebriated condition, quarreled with the de facto complainant, during which, the accused had abused him in a filthy language and attacked the de facto complainant and others, causing grievous injuries and also damaged the Auto belongs to one Ethiraj, which was parked nearby. He further submitted that the petitioner is arrayed as A1 and he is the main accused in this case and Goondas proposal is also pending.

4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and considering the fact that the goondas proposal is pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
