ORDER

The present transfer petition has been filed by the petitioner/wife seeking transfer of H.M.O.P.No.240 of 2024 pending on the file of the Subordinate Court, Tiruvottiyur to the file of the Family Court, Chennai.

2. Despite service of notice on the respondent, the respondent has neither chosen to appear in person nor through counsel. Hence, the respondent is called and set exparte.

3. I have heard the learned counsel for the petitioner.

4. Learned counsel for the petitioner has taken me through the averments made in the affidavit filed in support of this transfer petition. It is submitted that the connected divorce petition filed by the petitioner/wife in H.M.O.P.No.931 of 2025 is pending before the VII Additional Family Court, Chennai. In the interest of both parties, it is necessary that both the HMOPs be tried together before the same Court. In the light of the averments set out by the petitioner/wife, and the affidavit filed in support of the paper publication, I am satisfied that the Page No.2 of 4

petitioner has made out sufficient and good cause for seeking transfer as prayed for.

5. In view of the above, this Transfer Civil Miscellaneous Petition is allowed. Accordingly, H.M.O.P.No.240 of 2024, pending on the file of the Subordinate Court, Tiruvottiyur, is withdrawn and transferred to the file of the VII Additional Family Court, Chennai, to be tried along with H.M.O.P.No.931 of 2025. No costs. Consequently, the connected miscellaneous petition is closed.
