PRAYER: Plaint filed under Order IV Rule 1 of the O.S.Rules Read With Order VII Rule 1 of Civil Procedure Code, prayed for Judgment and Decree:- (a) directing the Defendants to jointly and severally pay a sum of Rs.30,54,29,780/-, as on date with interest at the rate of 15% per annum on the Principal sum of Rs.21,41,00,000/-, from the date of Plaint till the day of payment in full to the Plaintiff;

J U D G M E N T

The suit was filed for recovery of a sum of Rs.30,54,29,780/- with interest on the principal sum of Rs.21,41,00,000/- from the date of plaint until realization.

2. The parties reached a settlement and learned counsel for the plaintiff filed a memo dated 22.02.2023. The plaintiff is present in person. 2/4

In the memo, it is stated that a property measuring 5.17 acres was transferred by the defendants to the plaintiff under Document No.20877 of 2022 before the SRO, Thiruporur. It is further stated that another extent of 22.65 acres would be transferred and that the relevant conveyance deed is pending for registration before the SRO, Thirukazhukundram. Subject to these two registrations being completed, it is stated that the suit claim would stand fully settled.

3. In view of the above settlement, the suit is dismissed as settled out of Court without any order as to costs. Consequently, the plaintiff shall be entitled to refund of the full court fee and A.No.3066 of 2018 is closed. 23.02.2023 Index : Yes / No Internet : Yes / No kal 3/4
