Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant an order of ad interim injunction restraining the respondents 1 to 3 to forbear the 4th respondent namely R.Anitha, Wife of Ravishankar, Proprietor of the factory run in the name and style of Shri Padmaraj Jewellers functioning at No.40/41, Father Randy Street, R.S.Puram Coimbatore - 641 002 from running the factory (WMP.13339/2018) pending disposal of the above writ petition WP.11429/2018
Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.D.ASHOK KUMAR, Advocate for the petitioner and of MR.G.K.MUTHUKUMAR, SPECIAL GOVERNMENT PLEADER on behalf of the Respondents 1 TO 3 the court made the following order:- (Order of the Court was made by M.M.SUNDRESH, J.) Though this miscellaneous petition is pending for two years, notice is yet to be served on the 4th respondent, who is the contesting respondent.
2. The learned Special Government Pleader submitted that no papers have been served.
3. The direction which was originally issued on 16.03.2020 to serve notice to the 4th respondent has not been complied with.
4. In such view of the matter, we are not inclined to grant any interim order and this court is proposed to decide the main writ petition itself. This miscellaneous petition is accordingly closed, particularly, when there is no interim order from the year 2018 onwards.
