..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, directing the respondents to consider the representation dated 18.12.2021 to conduct sub division process bearing Survey No.46/5 an extent of 20 cents at Sennakiri Village, Salem South Taluk, Salem District and issue individual Patta to the petitioner based on the settlement deed dated 18.07.2015 within a reasonable time.

O R D E R

This Writ Petition has been filed to direct the respondents to survey and demarcate the boundaries of the property morefully disclosed in the prayer to this Writ Petition within a time frame to be fixed by this Court. The petitioner also seeks for sub-division of the property.

2.Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents.

3.At the outset, the learned Government Advocate, appearing for the respondents would point out that the representation dated 18.12.2021 given by the petitioner for survey and demarcation of the boundaries is an old one and therefore, he would submit that a fresh online application will have to be submitted by the petitioner with the 1st respondent. 4.Learned counsel for the petitioner who is appearing through VideoConferencing, on instructions, would submit that the petitioner is willing to submit a fresh online application with the 1st respondent seeking for survey and demarcation of the boundaries as well as for sub-division of the property.

5.Accordingly, this Court directs the petitioner to submit a fresh online application with the 1st respondent seeking for survey and demarcation of the boundaries of the property morefully disclosed in the prayer to this Writ Petition and for sub-division, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said online application from the petitioner, the 1st respondent shall survey and demarcate the boundaries of the property morefully disclosed in the prayer to this Writ Petition, after hearing the objections of all the neighbouring land owners and any other third party whom the 1st respondent deem fit to enquire, within a period of twelve weeks thereafter. If the petitioner is found eligible for subdivision of the property as prayed for in his application, the 1st respondent shall also sub-divide the property within the aforesaid period.

6.With the above direction, this Writ Petition is disposed of. However, there shall be no order as to costs.
