ORDER
This Criminal Original Petition has been filed seeking a direction to direct the Principal District Sessions Judge, at Kancheepuram District to consider the bail application sympathetically and pass orders on merits on the same day on the petitioner surrender in connection with Cr.No.41 of 2026 pending before the respondents Police.
2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.
3.It is seen from the records that the defacto complainant and the accused are adjacent landowners. On the date of occurrence, the defacto complainant went to the land and found it to be wet. When questioned the same, the accused abused her by using her caste name and assaulted her. 4.In view of the above factual position, there shall be a direction to the Principal District Sessions Judge, at Kancheepuram District to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.41 of 2026 on the file of the second respondent
Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
