Prayer: Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure, 1908 to withdraw the case in OP No.217 of 2019 on the file of the Sub Court, Kancheepuram and transfer the same to the Family Court, Erode. For Petitioner: Mr.T.A.Srinivasan

O R D E R

The wife seeks transfer of HMOP No.41 of 2019 (wrongly shown as OP No.217 of 2019) on the file of the Sub Court, Kancheepuram to the Family Court, Erode.

2. The transfer is sought for mainly on the ground of convenience of the wife who is a resident of Surampatti, Erode. She has launched the proceedings in Kancheepuram because the husband was residing in Kancheepuram. It is now claimed that the husband at present residing at Erode and therefore no inconvenience would be caused to him by the transfer of proceedings. It is seen from the records that notice to the husband in this proceeding, is served at Erode.

3. Considering the same, OP No.41 of 2019 on the file of the Sub Court, Kancheepuram is withdrawn and transferred to the Family Court, Erode to be disposed of in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
