ORDER

This Writ Petition is filed seeking for Writ of Mandamus to direct the respondent to consider and pass order on the petitioner's application for variation of conditions of permit dated 21.02.2025 in respect of Vehicle No.TN14/L-0474, permitted to ply on the route Tiruchengode to Dharmapuri, forthwith.

2. The learned counsel for the petitioner would submit that petitioner holds a stage carriage bus permit issued by the respondent for the route Tiruchengode to Dharapuram, in respect of Vehicle Number TN 14/L-0474, valid up to 09.03.2028. On 21.02.2025, the petitioner applied for variation of conditions of permit involving extension of route from Dharapuram to Narikalpatti for a distance of 24 Kms. The respondent on 24.02.2025 received the petitioner's application, however, the same was not processed the application by notifying the application under Section 6 of the Act 41 of 1992. Hence, the present Writ Petition.

3. Mr.N. Naveen Kumar, the learned Government Advocate takes notice for the respondent.

Learned Government Advocate appearing for the respondent would submit that the application for variation of conditions of permit dated 21.02.2025 in respect of Vehicle No.TN -14/L-0474, permitted to ply on the route Tiruchengode to Dharapuram forthwith, will be considered on merits and by giving due notice to the petitioner, opportunity of personal hearing and upon consideration of the objections, if any, orders will be passed within a specific time that may be stipulated by this Court.

5. Heard both sides and perused the records.

Considering the submissions made by both sides, this Court directs the respondent to consider the application of the petitioner for variation of conditions of permit dated 21.02.2025 in respect of vehicle No.TN 14 L/0474, after giving due notice to the petitioner, shall pass appropriate orders on merits 3/6

and in accordance with law, by providing opportunity of personal hearing, considering the objections filed by Anbarasu, Jagadesan and Rajammal, within a period of eight weeks, from the date of receipt of copy of this order.
