O R D E R

The petitioner, who was arrested and remanded to judicial custody on 24.11.2025 for the alleged offence under Sections 8(C), 20(b)(ii)(C) and 29(1) of NDPS Act, in Crime No.184 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that there are totally two accused and the petitioner is arrayed as A1, and the total contraband involved in the case is 25.300 kgs of ganja. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in custody since 24.11.2025 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, she prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the total contraband involved in the case is 25.300 kgs of ganja, which falls within the commercial quantity. He further submitted that 13 kgs of ganja was recovered from the petitioner, which constitutes an intermediate quantity, and that the petitioner has one previous case in Crime No.342 of 20225, which is still pending investigation. Hence, he opposed the grant of bail to the petitioner. 2/4

Taking into consideration of the totality of the circumstances and the fact that the contraband involved in the case is 25.300 kgs of ganja, which falls within the commercial quantity, the rigour of Section 37 of the NDPS Act operates against the petitioner. Hence, this Court is of the firm view that there are no extenuating circumstances in favour of the petitioner to grant bail.
