O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to consider and appoint the petitioner for the post of Assistant Professor in the quota reserved for SC/ST candidates with all other consequential benefits.

2.The case of the petitioner is that the petitioner has acquired M.Sc.Degree in Agriculture with Agronomy as main subject during the year 1998 and Doctorate in Agronomy during the year 2002. The petitioner has also appeared for the

National Eligibility Test during the years 1998 and 1999 and has passed in both the tests. Therefore, the petitioner is eligible and entitled to be considered for the post of Assistant Professor as per the requirements issued by the UGC as well as the rules provided by the second respondent.

3.It is the further case of the petitioner, that the second respondent has issued Notification dated 10.09.2004 calling for applications for a number of posts including the post of Assistant Professor in Agronomy. The petitioner applied for the same through proper channel, however, he was not issued with the call letter for attending the interview. Hence, the petitioner has come forward with this writ petition.

4.Heard the submissions made on either side.

5.This Court while entertaining the writ petition on 27.01.2006 has issued a direction to the petitioner to appear for interview to be held on 28.01.2006 which is subject to the result of the writ petition. Thereafter, vide order dated 09.07.2008, the interim order dated 27.01.2006 was made absolute. 6.The learned counsel appearing for the petitioner is not in a position to appraise the development subsequent to the interim order.

7.Hence, after a lapse of nearly twelve years, I do not find anything would survive for adjudication in this writ petition. Accordingly, the writ petition is closed as nothing survives for further adjudication. No costs.
