Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to grant compassionate appointment to the petitioner in any suitable post commensurate with petitioner's educational qualification on the basis of the application submitted by the petitioner on 07.07.2022 within a time limit fixed by this Court.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking appointment on compassionate grounds in any suitable post commensurate with the educational qualification of the petitioner. The petitioner had given an application on 07.07.2022.

2.It is stated that the father of the petitioner, Perumalsamy, had joined as Attender on 23.01.1992 in a non-regularized time scale under the 2nd respondent. He was not regularized in service. Thereafter, the father and others had filed the writ petition in W.P.No.17195 of 2010, which was ordered by the Court. His services were regularized w.e.f 11.03.2001 notionally and monetary benefits were given w.e.f 28.09.2007. The father was also promoted as Senior Factory Assistant on and from 11.03.2001. He unfortunately died on 07.04.2022. The petitioner had given an application seeking employment on 07.07.2022. Her mother and other sisters had given consent. By this Writ Petition, petitioner seeks examination of such representation.

3.It is contended on behalf of the respondents that the petitioner had married and therefore, cannot claim to be a dependent on her father but rather dependent on the husband.

4.This issue will have to be examined in detail, but first let the respondents apply their mind and examine the indigent circumstances surrounding the family of the petitioner and examine whether they are prepared to grant any employment on compassionate grounds to the petitioner herein. Necessary orders must be passed within a period of three months from the date receipt of a copy of this order. Accordingly, this Writ Petition stands disposed of. No cost.
