2/6 PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent 1 and 2 to survey and demarcate boundaries of the petitioner's land in S.Nos.186/2A, 186/2B, 186/2C, 186/2D, 186/2E to an extent of 1.45 acres situated at Omalur Villge, Omalur Taluk, Salem District with assistance of the 3rd respondent police based on his applications dated 03.02.2025 and 18.03.2025 respectively. ORDER
This writ petition has been filed for issue of writ of mandamus directing the 1 st and 2 nd respondent to act upon the online application submitted by the petitioner on 03.02.2025, wherein, the petitioner is seeking for the survey of the subject property and for demarcation of boundaries. 2.Heard Mr.M.R.Jothimanian, learned counsel appearing on behalf of the petitioner, Mr.P.Sathish, learned Additional Government Pleader appearing on
3/6 behalf of the respondents 1 and 2 and Mr.V.J.Priyadarsana, learned Government Advocate appearing on behalf of the 3 rd respondent.
3.The petitioner is placing reliance upon the Judgement and Decree passed in the Civil proceedings in order to trace the right over the subject property measuring an extent of 1.45 acres. The petitioner submitted an online application on 03.02.2025 after paying the necessary charges and sought for the survey of the subject property for demarcation of boundaries. Since the same was not acted upon, the present writ petition has been filed before this Court. 4.Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the 1 st and 2 nd respondents to act upon the online application submitted by the petitioner on 03.02.2025 and conduct the survey in the subject property based on the documents relied upon by the petitioner. If there are any rival claimants, such survey shall be conducted in their presence. If there is any likelihood of law and order problem, the 3 rd respondent shall give police protection. This process shall
4/6 be completed, within a period of four weeks from the date of receipt of copy of this order.
