The petitioner has come up with this Writ Petition seeking a direction to the respondents to close the TASMAC Shop No.2882 at Rasiravuthranahalli Village, Chinnampalli Panchayat, Pennagaram, Dharmapuri District.

Heard the learned counsel on either side and perused the material documents available on record.

The relief sought by the petitioner cannot be considered at this stage, as the petitioner has already made a representation to the respondents on 14.08.2017 and the same has to be considered in accordance with law.

Hence, without rendering any finding on the merits of the case, the 1st respondent/District Collector, Dharmapuri District is directed to consider the request of the petitioner by inspecting the Village where TASMAC Shop No.2882 is situated and ascertain as to whether the said Shop is situated in a prohibited area and whether it is being run in violation of the Rules and pass appropriate orders after hearing necessary parties within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of with the above direction. No costs.
