This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to deal with the representation made by the petitioner wherein the petitioner is seeking for cancellation of the mortgage deed dated 18.05.1983 registered as document No.2202/1983 on the file of Sub Registrar, Pallavaram, on the ground that the entire loan amount taken by the petitioner has been settled along with interest and in spite of the same, the mortgage has not been cancelled.
2. Heard Mr.Arumugarajan, learned counsel for petitioner and Mr.E.Sundaram, learned Government Advocate appearing for respondents 1 to 4.
3. It is seen from records that the petitioner had retired from service in the year 1997 and it is claimed by the petitioner that the entire loan amount has been settled along with interest in the year 1998 and 2/4
prima facie materials have been produced to substantiate the same. The petitioner made a representation in the year 2019 to the second respondent requesting for cancellation of the mortgage. Since no action was taken, the present writ petition came to be filed before this Court.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the petitioner to submit a fresh representation to the second respondent along with all the relevant documents and a copy of this order. The second respondent shall act upon the same and do the needful within a period of six (6) weeks from the date of receipt of a fresh representation from the petitioner.
This writ petition is disposed of with the above direction. No costs.
