The above petition has been filed to grant extension of Succession Certificate to the applicant /petitioner herein with power to collect the debts of the deceased A.M.Gopalan and G.Sujatha and to receive the interest thereon specified in the schedule hereunder.

2. The applicant is the wife of late A.M.Gopalan, who is aged about 75 years. In the Original Petition apart from the petitioner her son has been impleaded as respondent and the respondent has given consent to grant Succession Certificate to collect the debts of the deceased A.M.Gopalan and G.Sujatha in favour of mother who is the petitioner herein.

3. The legal heir certificate has been originally marked as Ex.P15 and the court had already confirmed that the petitioner and the respondent are the only legal heirs of late A.M.Gopalan. The learned counsel for the petitioner submitted that the assets now mentioned could not be included due to oversight and hence, the Succession Certificate already granted should be extended covering the assets now mentioned.

4. The learned counsel for the applicant invited the attention of this Court to Sec. 376 of the Indian Succession Act to extend the certificate 1/3

already granted to include the asset value of Rs.1,07,054/- as detailed in the application.

5. Taking into consideration of the relationship between the parties and also the submission made by the learned counsel for the petitioner, I feel that the succession certificate already granted should be extended in order to safeguard the interest of the petitioner and the respondent.

6. Accordingly, this application is allowed by extending the Succession Certificate already granted to the petitioner in OP.No.103 of 2022 in respect of the assets now detailed in petition stood in the name of late A.M.Gopalan.
