ORDER

This writ petition is filed to consider the report submitted by the fifth respondent.

2. Learned counsel for the petitioner would submit that the petition schedule mentioned property originally belonged to petitioner's grandfather, which was not partitioned or divided. However, the joint patta holders have illegally sold out the properties without the consent of other patta holders. Subsequently, the said survey field was subdivided and pattas were issued in favour of several persons without proper partition or consent of lawful heirs. Aggrieved over the same, the petitioner has sent a detailed representation dated 23.12.2024 before the first respondent, seeking verification of encumbrances, cancellation of patta issued in favour of third parties, and restoration of patta in accordance with the settlement records, which was forwarded to respondents 4 & 6 for enquiry, who later submitted a report detailing the subdivision history

and revenue records. Though the report was filed, no final order was passed, as on date. Hence, this writ petition.

3. Ms.Inthu Karunakaran, learned Government's Counsel takes notice on behalf of the respondents and submitted that the petitioner has failed to implead the third parties/illegal patta holders as respondents. Hence, she prays for dismissal of this writ petition.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In the present case, the petition schedule property belonged to the petitioner's grandfather and remains unpartitioned and undivided. Taking undue advantage of this situation, the other joint patta holders sold the properties to third parties without the consent of the lawful heirs, subsequent to which pattas were also issued in favour of those third parties. In this regard, the first respondent forwarded the petitioner's representation to respondents 4 and 6 to verify the encumbrance of the property. Consequently, a report was also filed. However, since no final order has been passed to date, the petitioner has filed this writ petition.

6. On perusal of the report submitted by respondents 4 and 6, it appears

that the issue involved in this case is civil in nature, concerning right, title, and possession. Therefore, neither the revenue authorities nor this Writ Court can decide the matter. Furthermore, as third-party interests are involved in the present case, the petitioner ought to have impleaded these third parties/illegal patta holders as respondents in this writ petition. However, none of the said third parties have been impleaded. Hence, this Court is not inclined to entertain this writ petition. However, the petitioner is at liberty to work out his remedy before the Civil Court in the manner known to law. In the result, this writ petition stands dismissed.
